Appellate court upholds prison terms for 3 medical students over sexual abuse

A Seoul appellate court upheld a lower court's prison terms on Friday for three former medical students for sexually harassing an inebriated female schoolmate during a trip.

The Seoul High Court's ruling confirmed the previous court's two-and-a-half-year prison sentence for a 24-year-old man surnamed Park and one-and-a-half-year terms for two other former students.

The upheld ruling also includes an order that their identities and personal information be published and made available to the public for three years.

The three former students of the medical college at Korea University, one of the most prestigious schools in the country, repeatedly groped body parts of a long-time female friend from the same school while she was sleeping under the influence of liquor, court records said.

They also took pictures of the woman being molested during the trip to an outskirt town in May last year.

"Their crimes are very serious given that they took advantage of her inebriation for sexual abuse," Judge Hwang Han-sik said.

"The victim sustained a grave shock and is facing difficulties leading a normal life."

The judge told the young convicts, "Life is long. I hope both the convicts and the victim will overcome the current difficulties and use this trouble as a chance to improve."

In September 2011, the three male students were expelled from Korea University over the sexual abuse allegations, which drew heavy media and public attention.

성추행 고대 의대생 2심도 전원 실형

동기 여학생을 성추행한 고려대 의대생 3명에게 항소심에서도 전원 실형이 선고됐다.

서울고법 형사8부(황한식 부장판사)는 3일 성폭력범죄의 처벌 등에 관한 특례법 위반 혐의로 기소된 고려대 의대생 3명 가운데 박모(24)씨에게 징역 2년6월, 한모(2 5)씨와 배모(26)씨에게는 징역 1년6월을 각각 선고했다. 모두 1심과 같은 형량이다.

또 3년간 이들의 신상을 인터넷을 통해 공개할 것을 명령하고 범행에 사용된 디지털 카메라를 몰수했다.

재판부는 "배씨는 추행사실이 없다고 주장하지만 최초 경찰에서의 진술과 고대 양성평등센터에 직접 써서 낸 진술서, 다른 동기들의 진술을 종합해 보면 추행사실을 인정할 수 있다"고 밝혔다.

또 "수년간 함께 생활한 동기 여학생이 술에 취해 반항하지 못하는 상태를 이용 해 추행한 것은 죄질이 매우 나쁘다. 피해 여학생은 큰 충격을 받고 정상적으로 생활하지 못하는 등 2차 피해도 받고 있다"며 "범행 내용과 가담 정도를 고려해 형을 정했다"고 설명했다.

황 부장판사는 선고를 마친 뒤 학생 신분으로 전과가 없는 이들에게 중형을 내린 이유에 대해 거듭 설명했다.

황 부장판사는 "젊은 인재들의 하룻밤 잘못된 행동에 대해 실형을 선고하는 것을 안타깝게 생각한다"고 전제하면서도 "이들의 행위가 한 차례 감경을 해도 징역 1 년6월 이상의 형을 내려야 하는 중죄에 해당하고 피해자의 2차 피해가 너무 크기 때 문에 집행유예를 선고할 수는 없다"고 말했다.

그는 이어 "인생은 길다"며 "피해자와 피고인 모두 현재의 어려움을 이겨내고 전화위복의 계기로 삼길 바란다"고 당부했다.

이들 3명은 지난해 5월 동기인 A(여)씨와 함께 경기도 가평으로 여행을 가 A씨가 술에 취해 정신을 잃은 사이 성추행했으며 박씨와 한씨는 휴대전화와 디지털카메 라로 성추행 장면을 촬영한 혐의로 모두 구속기소됐다.

앞서 고려대는 지난해 이들 3명에게 최고 수위의 징계인 출교 처분을 내렸다.

출교 처분을 당한 학생은 학적이 완전히 삭제되고 재입학이 원칙적으로 불가능하다.
